Here\u2019s How to Enforce Your Recovery Certificate Against the Builder"},"content":{"rendered":"\n<p><strong>Introduction<\/strong><\/p>\n\n\n\n<p>The <strong>Real Estate Regulatory Authority (RERA)<\/strong> has brought a new era of <strong>transparency, accountability, and discipline<\/strong> in the Indian real estate sector. With all project-related details now publicly accessible, <strong>homebuyers feel more confident<\/strong> when investing in property. However, challenges still arise when <strong>builders fail to comply<\/strong> with RERA\u2019s orders \u2014 particularly when it comes to refunds or compensation.<\/p>\n\n\n\n<p>So, what can a homebuyer do if a RERA order goes unenforced? This blog explains <strong>how to effectively enforce a RERA Recovery Certificate<\/strong> and ensure justice is served.<\/p>\n\n\n\n<p>RERA, under the <strong>RERA Act, 2016<\/strong>, empowers homebuyers to file complaints against developers who <strong>fail to deliver possession<\/strong>, <strong>delay projects<\/strong>, or <strong>refuse refunds<\/strong> despite prior commitments. Revenue Code, 2006<\/strong> in Uttar Pradesh.<\/p>\n\n\n\n<p><strong>Recovery of Arrears of Land Revenue in Uttar Pradesh<\/strong><\/p>\n\n\n\n<p>Under <strong>Section 170 of the U.P. Revenue Code, 2006<\/strong>, the DM can recover dues using one or more of the following methods:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Arrest and detention<\/strong> of the defaulter (builder)<\/li>\n\n\n\n<li><strong>Attachment and sale<\/strong> of movable or immovable property<\/li>\n\n\n\n<li><strong>Attachment of bank accounts or lockers<\/strong><\/li>\n\n\n\n<li><strong>Sale or lease of the land or property<\/strong><\/li>\n\n\n\n<li><strong>Appointment of a receiver<\/strong><\/li>\n<\/ul>\n\n\n\n<p>These tools are meant to pressurize the builder to comply with the RERA order. However, <strong>arrest and detention<\/strong> is usually symbolic and rarely enforced beyond <strong>15 days<\/strong>, as per <strong>Section 171<\/strong>.<\/p>\n\n\n\n<p><strong>What if the District Magistrate Doesn\u2019t Act?<\/strong><\/p>\n\n\n\n<p>Despite having the legal authority, sometimes the DM fails to act on the Recovery Certificate.
